Lotus ScanTerms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Lotus Scan mobile application (the "App") and the website located at www.scanyourmtg.com (the "Website"), operated by Lotus Scan ("we," "us," or "our"). Your access to and use of the App and Website is conditioned upon your acceptance of and compliance with these Terms.
1. Acceptance of Terms
By downloading, installing, or using the App, or by accessing the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App or Website.
2. Description of Service
Lotus Scan is a mobile application for iOS that enables users to scan Magic: The Gathering trading cards using their iPhone camera. The App provides card identification, market price information, and collection management features. The Website provides information about the App, guides, and comparisons with other services.
3. Eligibility
You must be at least 13 years of age to use the App and Website. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App and that they have agreed to these Terms on your behalf.
4. User Accounts and Data
The App may allow you to create and manage card collections, decks, and wishlists. You are solely responsible for maintaining the confidentiality of your data and for all activities that occur through your use of the App. We are not responsible for any loss of data resulting from device failure, software updates, or user error.
5. Permitted Use
You agree to use the App and Website only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App or Website in any way that violates any applicable federal, state, local, or international law or regulation;
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App;
- Copy, modify, distribute, sell, or lease any part of the App or Website, or attempt to extract the source code;
- Use automated systems, bots, or scrapers to access the App or Website in a manner that exceeds reasonable use;
- Transmit any viruses, worms, or other malicious code through the App or Website;
- Use the App to infringe upon the intellectual property rights of Wizards of the Coast, Hasbro, or any other third party.
6. Intellectual Property
The App, Website, and all associated content (including but not limited to text, graphics, logos, icons, software, and design elements) are the property of Lotus Scan and are protected by copyright, trademark, and other intellectual property laws.
Magic: The Gathering is a trademark of Wizards of the Coast LLC, a subsidiary of Hasbro, Inc. Lotus Scan is not affiliated with, endorsed, sponsored, or specifically approved by Wizards of the Coast LLC. All card images, names, and related intellectual property belong to their respective owners.
7. Card Pricing Information
The App displays card pricing information obtained from third-party sources. While we strive to provide accurate and up-to-date pricing data, we make no representations or warranties regarding the accuracy, completeness, or reliability of such pricing information. Card prices are subject to market fluctuations and may vary between sellers and platforms. You should not rely solely on pricing information provided by the App for buying or selling decisions.
8. Disclaimer of Warranties
THE APP AND WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOTUS SCAN, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP OR WEBSITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP OR WEBSITE; (C) ANY CONTENT OBTAINED FROM THE APP OR WEBSITE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
10. In-App Purchases
The App may offer in-app purchases through the Apple App Store. All purchases are processed by Apple and are subject to Apple's terms and conditions. We do not process payment information directly. Refund requests for in-app purchases must be directed to Apple.
11. Termination
We reserve the right to terminate or suspend your access to the App and Website immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App and Website will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App or Website shall be subject to the exclusive jurisdiction of the courts of Spain.
13. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the App or Website after the revised Terms become effective constitutes your acceptance of the revised Terms.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
